الملخص:

يقوم هذا البحث على دراسة موضوع فقهي بعنوان: "أبو بكر الأصم واختياراته الفقهية –عرض ومقارنة"، وقد انبنى من تمهيد، وثمانية مباحث، وخاتمة، خُصِّصَ التمهيد لدراسة حياة أبو بكر الأصم ومؤلفاته، ثم جاءت المباحث الثمانية الأخرى، لتغطي موضوعات البحث المختلفة، فكان المبحث الأول في اختيارات أبو بكر الأصم الفقهية في العبادات، والثاني في اختياراته الفقهية في المعاملات، والثالث في اختياراته الفقهية في الأطعمة والصَّيد، والرابع في اختياراته الفقهية في العقوبات، والخامس في اختياراته الفقهية في النكاح، والسادس في اختياراته الفقهية في الميراث، والسابع في اختياراته الفقهية في القضاء، والثامن في اختياراته الفقهية في الخلافة، وقد خلص البحث الى جملة من النتائج كان من أهمها أن اعتماد أبو بكر الأصم الكبير على العقل وقلة عنايته بالحديث، جعل غالبية آرائه الفقهية تخالف النصوص الشرعية، وتكون محل انتقاد كبير من قبل العلماء.

:Abstract

This research is based on jurisprudential subject entitled: « «Abu Baker Al-Assum, Jurisprudence Choices - Presentation and Comparison». It consisted of introduction, eight chapters and a conclusion. The introducttion was allocated to the study of Abu-Baker’s life and his writings while the other eight chapters cover the various research topics. The first chapter discusses Abu Baker’s choices in the field of worship؛the second choices in  dealings؛the third choices in food and fishing؛the fourth his jurisprudence choices in penalties؛the fifth choices in the doctrine of marriage؛the sixth choices in the inheritance؛the seventh his choices in the jurisprudence of judiciary؛and the eighth his doctrinal choices in succession (Kilafah ). The research has reached a number of research conclusions .The most important conclusion was his complete reliance on reason, and the lack of his attention to Hadith made the majority of his jurisprudence views contrary to Shariia’ texts, and the subject of considerable criticism from great jurisprudence scholars .
